Public Offer
1. General
1.1 This is public offer for the order delivery of the grocery products and other goods at grocery.kz.
1.2 The placing of the order at grocery.kz is the Buyer's consent to the terms of this Public Offer, as well as the consent to accept and pay for ordered goods or/and their delivery to the Seller who delivered the order according to the conditions of the Public Offer.
1.3 There is following terms and definitions in the Public Offer:
- “Buyer” – person who has placed an order at grocery.kz.
- “Seller” - management of grocery.kz.
- “Site” - grocery.kz.
- “Public offer” - a public offer by the Seller addressed to any person who want to place an order delivery of grocery products and other goods according to the conditions indicated in the Public Offer, based on which the Seller delivers ordered grocery products and/or other goods from warehouses and stores of Partners.
- “Acceptance” - full and unconditional acceptance of the terms of this Public Offer by the Buyer.
- “Product” – grocery products and other goods.
- “Order” - a list of Products specified by the Buyer during checkout at grocery.kz.
- "Delivery" - the Seller's courier services which allow delivery of the order to the Buyer.
2. Subject of the Public Offer
2.1 The Buyer places order of the delivery of grocery products and/or other goods at grocery.kz, the Seller deliver the order to Buyer. The Buyer must pay for ordered goods and/or for their delivery.
3. Placing of the order
3.1 Buyer places order at grocery.kz. The buyer provides following personal data during placing of order:
- Name and Surname
- Delivery address
- Mobile phone number
3.2 The Buyer expresses his consent to the processing of personal data by the Seller, to the reflection of personal data in the personal account of the Buyer at grocery.kz. Under the processing of personal data is meant collection, systematization, accumulation, storage, use, distribution of e-mails and SMS messages, informing about promotions and other actions necessary for the execution of this Public offer. The Seller undertakes to take the necessary and enough measures to protect the Buyer's personal information from unlawful or accidental access, destruction, alteration, blocking, copying, distribution, as well as from other illegal actions of third parties.
3.3 The buyer is responsible for the accuracy of the provided personal data personally.
3.4 The placing of the order at grocery.kz means the Buyer's consent to the terms of this Public Offer. The date of the transaction between the Seller and the Buyer is the date of placing of the order at grocery.kz. The Buyer placing an order at grocery.kz agrees to the payment and delivery terms.
3.5 All information posted at grocery.kz is for reference and may convey information about certain properties and characteristics of the ordered grocery products or/and other goods not fully, but this information will be updated on a regular basis to describe all required properties and characteristics about grocery products and other goods fully.
3.6 The Seller is entitled to amend and/or supplement this Public Offer at any time without prior and subsequent notice to the Buyer. Any changes and/or additions take effect from the moment of its posting at grocery.kz.
4. Reception and return of Products
4.1 The Buyer can:
4.1.1. refuse the ordered Products / parts of the Products at any time prior to the delivery of the order to the Buyer previously informing the Seller about this decision by phone or email indicated at grocery.kz;
4.1.2 return or exchange the Products in case of defects in the their quality previously informing the Seller about the identified defects in the quality by phone or email indicated at grocery.kz within 7 calendar days from the date of their delivery;
4.2. Refunds to the bank card is carried out within 3-10 business days according to the terms of the Bank.
5. Delivery terms
5.1. The Seller delivers the Products based on the order placed by the Buyer at grocery.kz.
5.2. Delivery cost is included in the order cost and must be paid by the Buyer. Delivery cost is formed at the time of placing of the order.
5.3. Ownership of the ordered Products, as well as the risk of accidental loss or damage passes from the Seller to the Buyer at the time of delivery of the Products to the Buyer.
6. Order, price and terms of settlements
6.1 The price of each product is displayed at grocery.kz. These prices may be changed by the Seller unilaterally without notice to the Buyer. In the event of a change in the price of the ordered Products before the processing of the order, the Seller will immediately try to contact the Buyer to confirm new order total or replace the Products with the changed price by analogue Products. If the Buyer was unable to contact the Buyer after two attempts, the ordered Product will be deleted from the Buyer's bill.
6.2 If the ordered Product is not available, the Seller will offer replacement of the missing Product. The Seller will remove the cost of the missing product from the Buyer's bill in the absence of an alternative offer or if the Buyer will not agree with the replacement.
6.3 Payment for the Products and/or their delivery is made by the Buyer in tenge by card or cash during delivery of the Products.
6.4 The Buyer's obligations to pay for the order and/or its delivery are deemed fulfilled from the moment of receipt of funds to the Seller’s account or receipt of cash by the courier who delivered the order.
7. Responsibility of the Parties
7.1 The Parties will be liable in accordance with the current legislation of the Republic of Kazakhstan for the failure to fulfill or improper performance of obligations under the Public Offer.
7.2 The seller can transfer his rights and obligations to fulfill orders to the third parties.
7.3 Any claims must be resolved peacefully. The Buyer can send all claims for improper processing of the order to the email or WhatsApp number indicated at grocery.kz. The claim must include a specific list of violations from the Seller, the number and date of the Order, the contact details of the Buyer who submitted the claim.
8. Validity of the Public Offer
8.1 Agreement between Seller and Buyer according to the condition above will enter into force from the moment of placing of the order and is valid until the Parties fulfill their obligations fully.
